Terms of Service
Effective: May 7, 2025
Dawn Tap, LLC ("we," "us") owns and operates energy.independent.homes ("Platform") for Energy Independent Homes ("EIH"), a movement to empower energy independence. These Terms of Service ("Terms") govern access to and use of the Platform, including account registration, appointment scheduling, and solar estimate tools, pursuant to Arizona law.
1. Acceptance
By accessing the Platform, you agree to these Terms. If you do not agree, you may not use the Platform.
2. EIH’s Role
EIH facilitates connections between homeowners and vetted contractors, solar dealers, and financiers. Transactions occur directly between users and third parties, with EIH bearing no liability for their performance.
3. Account Registration
Users must provide accurate information (e.g., name, email, password) and are responsible for account security and activities.
4. Appointment Scheduling and Quotes
Users scheduling appointments consent to PII and solar data disclosure to contractors, dealers, financiers, and manufacturers for verified quotes, as detailed in the Privacy Policy. Quick estimates are generated in-house and not shared externally.
5. Software and Content
The Platform uses software licensed from VIZRIZ (a Dawn Tap technology partner) and content (e.g., videos, guides) owned by Dawn Tap. Users are granted a limited, non-exclusive license to access these, subject to these Terms.
6. Third-Party Services
The Platform integrates Acuity Scheduling (booking), Zoom (meetings, currently via redirects, future API integration), and YouTube (video embeds). We are not liable for their performance, policies, or data practices.
7. User Conduct
You may not:
- Use the Platform for unlawful purposes or to violate third-party rights.
- Attempt unauthorized access or data scraping.
- Misrepresent information provided.
8. Termination
We may suspend or terminate access for violating these Terms, without notice.
9. Limitation of Liability
The Platform is provided "as is." We disclaim liability for:
- Errors, interruptions, or unavailability.
- Third-party actions (e.g., contractors, Acuity, Zoom).
- Losses from Platform use, to the extent permitted by law.
10. Future Structure
If EIH transitions to a decentralized cooperative, these Terms will apply, with VIZRIZ or another partner enforcing them as needed.
11. Governing Law
These Terms are governed by Arizona law. Disputes shall be resolved in state or federal courts in Maricopa County, Arizona.
